Casework: Citizen Opposition to Tire-Burning Plans Leads to Strong Legal Precedent Supporting Public Participation

CELA worked with other environmental lawyers, groups and residents to successfully stop a controversial proposal to burn scrap tires, plastics and other waste as “alternate fuel” in an Ontario cement plant. 

This case resulted in landmark decisions under the Environmental Bill of Rights (EBR) by the Environmental Review Tribunal and the Ontario Superior Court of Justice (Divisional Court). 

These precedents continue to assist other Ontario residents in EBR appeals of ill-conceived approval decisions by Ontario’s Ministry of the Environment and Climate Change.
