Legal Information: Municipal Powers to Address Climate Change

This memorandum briefs municipalities on their broad jurisdiction to enact by-laws dedicated to tackling environmental concerns. It outlines powers granted from provincial legislation including the Municipal Act and the Planning Act. Municipal powers to address climate change also arise in the jurisprudence including the precedent-setting Supreme Court of Canada decision, Spraytech v Hudson. This memorandum is published to inform municipalities about their powers to further address environmental issues in Canada.
